Official Contest Rules
- ELIGIBILITY: Entry open to all at
http://www.airventure.org/video/submit.html Employees of Experimental Aircraft Association, Inc. (the “Sponsor”) and their immediate family members and those living in the same household of such employees and family members are not eligible to win. Contest governed by the law of the State of Wisconsin and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
- NO PURCHASE IS NECESSARY TO ENTER.
- CONDITIONS ON ENTRY. All Entries must be received by 11:59 PM CDT on September 30th, 2007. A Contest entry shall consist of an “Original Video Submission” owned by the Entrant, as more fully described herein. An Original Video Submission is an original expression, in audio-visual form, made by the person submitting the Original Video Submission, as more fully described herein (the “Entrant” or “you”) of the Entrant’s original content, including but not limited to ideas, language, images, text, graphics, animation and/or music, which illustrates any of the wide variety of aviation-related activities at EAA AirVenture Oshkosh 2007, and the unique community and culture surrounding the event. The Original Video Submission must (i) be in digital format that meets the requirements for upload on the Brightcove Service, (ii) be no shorter than 30 seconds and no longer than 300 seconds in length, and (iii) constitute original work and the sole and exclusive property of the Entrant over and with respect to which the Entrant has all rights, including but not limited to those rights mentioned in these Official Rules. Entries may not use any music or images subject to copyrights not owned by the Entrant. If any identifiable person other than the Entrant appears in the Original Video Submission, the Entrant must know the names and addresses of all identifiable persons and must have written permission from those persons to submit the Original Video Submission.
By submitting an entry, you grant permission, without limitation, for your Original Video Submission to be displayed online or otherwise used by Sponsor in whatever format or formats, and at such time or times and as frequently as Sponsor, in its sole discretion, determines, without regard to whether Your Original Video Submission has or has not advanced to Round Two or been named the winning entry, and to be retained indefinitely by Sponsor. Further, by entering you warrant and represent that your Original Video Submission is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your Original Video Submission and other entry materials (including, without limitation, the rights to make visual images and recordings and distribute such images and recordings of any persons appearing in the Original Video Submission and any photographs, music or video clips included in the Original Video Submission) and that your Original Video Submission does not violate any law, regulation or any right of any third party, including but not limited to rights of copyright, publicity and privacy.
Submitting an Original Video Submission that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you.
Entries, including the Original Video Submission, may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person’s personal or proprietary rights. Original Video Submissions that are deemed by the judges in their sole discretion to be overtly commercial, irrelevant, unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, immoral, obscene, pornographic, profane, libelous, invasive of privacy or publicity rights, hateful, or racially, sexually, ethnically or otherwise objectionable or not in keeping with Sponsor’s image will be disqualified. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor’s sole opinion, endangers the safety or well being of any person or as to which , in the Sponsors sole opinion, the Entrant has not complied with these Official Rules. Other than for winner notification, neither Sponsor nor anyone acting on its behalf will enter into any communication with any Entrant regarding this Contest, nor will entries be acknowledged.
- ADDITIONAL REQUIREMENTS: Once you complete and submit your video, your Original Video Submission is final and may not be modified or edited. No Original Video Submissions will be returned. The person named as the registered owner of the user account on the Brightcove Service associated with the Original Video Submission will be deemed the Entrant. In the event of a dispute regarding the identity of an Entrant, the dispute will be resolved in favor of the individual who is the "authorized e-mail account holder" of the e-mail address provided when the Brightcove user account was created. "Authorized email account holder" is defined as the natural person assigned an e-mail address by an Internet access provider, online service provider, or other organization (i.e., business, education institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If any group of individuals elects to collaborate on an Original Video Submission, they are required to designate one (1) representative to comply with the entry and other requirements of these Official Rules, enter the Contest and accept the prize on behalf of the group. Sponsor is not liable for any dispute between collaborators related to an Original Video Submission.
- JUDGING: There will be two rounds of judging in this Contest. In Round One, a panel of judges selected by the Sponsor will review all Original Video Submissions and create a shortlist of ten finalists. All Round One Submissions will be judged by the judges in their sole judgment according to the following judging criteria: 1) 50% creative expression; 2) 20% representation of activity at EAA AirVenture Oshkosh 2007; 3) 30% representation of community and culture at EAA AirVenture Oshkosh 2007. In the event of a tie in Round One, the Entrant with the highest score in "creative expression" criterion will move on to Round Two. In the event of a further tie, the Entrant with the highest score in "representation of community and culture at EAA AirVenture Oshkosh 2007" criterion will move to Round Two. The Judges' decisions are final and binding in all respects. The ten finalists will be promoted in the Sponsor’s publications and websites. An online poll posted online at
www.airventure.org will allow visitors to view and vote for their favorite Original Video Submission. The poll will run from October 4th 2007 until 11:59 PM CDT on October 19th, 2007. The winner will be announced on October 25th, 2007. The Grand Prize will be awarded to the video that receives the highest number of votes (Subject to verification).
In the event of ties in Round Two, the Entrant with the most online video views will be deemed the winner. In the event of further ties, the Entrant with the highest score for "creative expression" in Round 1 will be deemed the winner.
- GRAND PRIZE: One Grand Prize will be awarded, consisting of a Canon HV20 High Definition Camcorder.
- GENERAL: All taxes on prize and all expenses related to acceptance and use of the prize not specified are the sole responsibility of the prize winners. Sponsor will file a Form 1099 with the U.S. Internal Revenue Service to report the value of the Grand Prize awarded to the winning Entrant; the winning Entrant must provide his or her Social Security Number to Sponsor in order to receive the Grand Prize.
By participating, each Entrant agrees: (a) to comply with these Official Rules and to accept the decisions of Sponsor, which shall be final in all respects relating to the Contest; (b) to release, discharge and hold harmless Sponsor from any and all injuries, liability, losses and damages of any kind resulting from the Entrant’s participation in the Contest or his or her acceptance, use or misuse of the Grand Prize including, without limitation, personal injury, death and property or economic damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy; and (c) that Entrant has received good and valuable consideration for all obligations and other burdens undertaken by Entrant and all rights and other benefits received by Sponsor in connection with this Contest.
No prize transfer or cash redemption. No prize substitution, in whole or in part.
- WINNER LIST: To receive the winner’s name, mail a self-addressed, stamped envelope to be received by December 31st, 2007, to: EAA Video Competition, 3000 Poberezny Road, Oshkosh, WI, 54903.
- MISCELLANEOUS: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to Entrant's or any other person's computer related to or resulting from participating in the Contest. By participating in the Contest, you agree to be bound by these Official Rules, including all eligibility requirements, and by the decisions of the Sponsor, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction impairs its ability to conduct the Contest), and to determine the winner from among all eligible entries received prior to withdrawal.
